MJog Messenger App Terms and Conditions

The MJog Messenger App (the “App”) is made available by MJog Limited, a company limited by guarantee and registered in England with the number of 2313464; Registered office: The Old School, 23 High Street, Wilburton, Ely, Cambridgeshire CB6 3RB. MJog is the trading name of MJog Limited (“MJog”,“us”,“we” or “our”)

By downloading and registering the App, using your mobile number to verify your identity which you will share with us, you agree to these terms and conditions of use (App Terms). This will create a legal agreement between you and MJog, which sets out below, your use of the App.
If you do not agree to the App Terms, you should immediately discontinue using and uninstall the App.

Our App Terms should be read alongside our Privacy Policy and Cookie Policy.

General Terms

Depending on the version of the App you have downloaded (iOS or Andriod), these App Terms incorporate Apple’s or Google Android’s terms and conditions and privacy policies (“Platform Terms”)

If there is any conflict between App Terms and the Platform Terms then these App Terms will prevail.

We may from time to time vary these App Terms. Please regularly check for any updates which we announce, to ensure you are aware of any variations made by us.
If you continue to use the App, you are deemed to have accepted such variations and the new App Terms. If you do not agree to such variations, you should stop using and uninstall the App.

MJog Smart Service

We provide a digital messaging and information communication service to your health care provider, the “MJog Smart service” (MJog Smart service).
“MJog Smart” may be used by your health care provider to send messages and information to you whilst you are using the App.
When you register for this service you are agreeing to receive messages from your Practice – if you do not wish to use this service uninstall the app.
The App will allow you to receive and reply to such messages, along with any other information and requests contained therein.
You may receive messages such as reminders for appointments that you have booked with your health care provider, together with additional health care messages and online information.

Sometimes we will want to enhance the App and the services that we can offer by adding new features and functionality to MJog Smart and the App, or we may deem in necessary to alter, amend or even remove features. This will be entirely at our discretion.
All updates will be mandatory, and failure by you to install them may result in the App no longer functioning correctly, or become unavailable to receive messages from your health care provider.

Technical Requirements

The App is available on both Apple and Googles Android with internet enabled services, our App will work on the following versions and above.

  • Android: Jelly Bean (4.4), Kit Kat, Lollipop (and above)
  • iOS: iOS 9 (and above)

The App will need a minimum of 22MB free storage on your device, and we have the right to terminate the App on any of the OS as we see fit if it cannot function correctly.
Even if your device adheres to the above technical requirements, we cannot guarantee that the App will always work on your device.
Our technical requirements may be updated from time to time, due to updates that we may need to make to the App.

Your Privacy

You agree that we are able to send ‘Crash Reports’ (details of what happened if the App crashes) to Functional Software, Inc. ( No personal identifying information will be sent to Functional Software Inc and your phone number will not be shared. Their privacy statement is here:

Any data that we collect from you through your use of the App is subject to MJog’s Privacy Policy.

By agreeing to these Terms, you also have acknowledged that you’ve read, understood, and accepted our Terms and Privacy Policy.

Use of the Service

Except as otherwise stated, anyone who is a resident of the United Kingdom that is [13] years of age or older can use the App to receive messages via Smart from their health care provider.
However, we may terminate your use of the App at any time, as explained below under the “Termination” heading, if you breach our conditions for Acceptable Use.

If you are under the age of [13] years (a “Child”), then you may only register to use the App and receive messages from the MJog Smart service if prior consent has been given by your parent or guardian, and they have agreed to these Terms, as the party to this agreement, on your behalf.

Acceptable Use

You will not use the App for anything which:

  • is unlawful, illegal or unauthorised.
  • for commercial non-personal purposes.
  • is obscene or offensive.
  • is defamatory of any other person.
  • promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation or age.
  • infringes any copyright, database right or trade mark of any other person.
  • is likely to harass, upset, embarrass, alarm or annoy any other person.
  • is likely to disrupt our service in any way, or
  • advocates, promotes or assists any unlawful act such as (by way of example only) copyright infringement or computer misuse.

Intellectual Property

You acknowledge that all intellectual property rights in the App anywhere in the world belong to us or our licensors.
The rights in the App are licensed and not sold to you, so you have no rights in or to the App, other than the right to use it in accordance with these Terms.


MJog Ltd make no warranties of any kind, expressed or implied about the MJog Smart service or App that we provide.

We cannot guarantee the factual content of any information sent to you via “Smart” and delivered to you within the App.

We will not be held responsible for any loss or damages you may suffer due to using the App, or acting upon information delivered to you by the App which has been sent to you via the MJog Smart service.
The information delivered to you by the App is not a substitute for a health care professional, and you should always seek medical advice from a health care expert for any medical condition.

We make no claims over the reliability, timeliness or effectiveness of messages and information sent via the MJog Smart service and delivered to you in the App, or its fitness for a particular purpose.
This includes any resulting inconvenience from the late, wrong or non-delivery of any messages or any Smart service interruption accidentally caused by us, or connecting services (the internet, wi-fi, 3G/4G).


We may update, suspend, or terminate these Terms at any time, with or without cause.
The suspension or termination will take effect upon us sending written notice to you via the App, and will also be displayed on the MJog website at
You may also choose to terminate these Terms at any time by uninstalling the App.
In the event of these Terms being terminated for whatever reason:

  • your licence to use the App and to receive messages from the MJog Smart service shall immediately terminate;
  • you should immediately cease to make use of the App and uninstall it from your device;
  • within a reasonable period of time following termination (but no earlier than 30 days following termination) we shall use our reasonable endeavours to delete any information that we may hold about you or your use of App from our servers. Following deletion, we will no longer be able to retrieve or recover any of these records.
